1.Scope of Application
1.1Applicability
These General Terms and Conditions (GTC) apply to all services and deliveries provided by LOG-LAB Hügli in connection with the acceptance, development, and processing of analogue photographic material.
1.2Customers / Deviating Agreements
They apply to both private customers and business customers, unless deviating agreements have been made in writing.
2.Conclusion of Contract
2.1Formation of the Contract
A contract between LOG-LAB Hügli and the customer is concluded as soon as the customer hands over material for development (in-store at Jurastrasse 1, CH-3013 Bern; at a LOG-LAB market stand; or by postal shipment) or places an order for a service in writing or electronically.
2.2Acceptance of the GTC
By handing over or sending the material, the customer acknowledges these GTC as binding.
2.3Order Confirmation / Rejection
LOG-LAB Hügli confirms the conclusion of the contract by email within 2 working days after receipt of the material. In case of overbooking, technical limitations, or non-processable material, LOG-LAB Hügli reserves the right to reject the order and return the material within 7 working days.
3.Scope of Services
3.1Core Offering
LOG-LAB Hügli offers the development of film material as well as complementary services within the field of photographic practice.
3.2Professional Execution / Technical Deviations
LOG-LAB Hügli undertakes to carry out development professionally and according to recognized standards. Colour or brightness deviations may be technically inherent and do not constitute a defect.
3.3Rejection / Partial Processing
LOG-LAB Hügli reserves the right to reject damaged or non-developable material (e.g., due to moisture, age, chemical impact, etc.) or to process it only partially.
3.4Detailed Service Description
LOG-LAB Hügli offers the following service packages:
- Develop (C-41 or B&W): Film development according to process (C-41 / black-and-white).
- Scan from fresh film (in addition to development): Normal scan, High scan, DNG & FullRes.
- Push/Pull development: Development with adjusted exposure (surcharge according to price list).
- Express / Overnight: If offered and confirmed, subject to surcharge (according to the current price list).
- Editing: Image editing by arrangement (e.g., "Master").
- Print orders.
3.5Quality Assurance
Quality assurance at LOG-LAB Hügli is based on an end-to-end Project ID / QR-code workflow and modern equipment for development and scanning:
- Project ID / QR-code zero-error workflow: Each film receives a unique Project ID and QR code at intake. Film, canister, envelope/pouch and the digital job are linked so mix-ups are largely avoided.
- End-to-end traceability: The Project ID accompanies the order from intake through development and scanning to delivery. Process steps, settings and notes can be clearly assigned.
- Modern developing machine: Development is carried out with a controlled, reproducible process (e.g., temperature, chemistry timing, throughput) to ensure consistent results.
- Modern scanning devices: Contemporary scanning systems are used to ensure stable, high-quality reproduction (sharpness, dynamic range, even illumination).
- Digital deliveries: Provided via portal.
3.6Presets and Colour Rendering
LOG-LAB Hügli delivers scans with consistent tonality across the entire roll and a colour interpretation that respects the chosen film stock. Customers may choose the preferred starting point for their workflow:
Neutral Scan: Clean, restrained base file for further grading/editing. The technical scan characteristics depend on the chosen scan option.
Important: Scans are always an interpretation. LOG-LAB Hügli ensures consistency from frame to frame and alignment with the selected option (Neutral/Look as well as Standard/Premium). Special requests can be stated when placing the order.
4.Prices and Payment Terms
4.1Prices / VAT
All prices are stated in Swiss francs (CHF). As long as LOG-LAB Hügli is not subject to VAT, no VAT will be shown. Once VAT liability applies, prices include statutory VAT unless stated otherwise.
4.2Invoicing / Due Date
Payment is made by invoice, which is provided electronically. The invoice amount is due within 14 days net.
4.3Late Payment / Reminder Fees
In the event of late payment, LOG-LAB Hügli reserves the right to charge reminder fees and default interest. LOG-LAB Hügli may charge a reasonable reminder fee:
- 1st reminder: no fee
- 2nd reminder: CHF 10.–
- 3rd reminder: CHF 30.–
Further measures remain reserved.
4.4Price Adjustments and Discounts
LOG-LAB Hügli reserves the right to adjust prices in the event of material changes in market conditions (e.g., chemicals, energy, fixed costs, variable costs or material costs). Existing orders are not affected. Individual conditions may be agreed for business customers and regular customers.
5.Delivery, Collection and Storage
5.1Digital Delivery / Shipping
Finished orders are exported after development, scanning and editing as agreed and made available via a password-protected download portal. Negatives can be shipped by post to the address provided by the customer upon request. Shipping is at the customer's risk.
5.2Liability of Shipping Service Providers
LOG-LAB Hügli is not liable for delays or damage caused by shipping service providers.
5.3Storage Period / Destruction / Deletion
Developed image material, negatives and scans are stored for 30 days after completion of the order and then professionally destroyed and/or deleted. An extension of the storage period is only possible with a written agreement.
5.4Processing Times and Express Services
The standard processing time is 14 working days from receipt of the material at the lab. The following express options are available subject to surcharge:
- Express service (72 hours): Surcharge according to the current price list.
- Overnight service: Available from 2 films, surcharge according to the current price list.
Express services are only possible after prior arrangement and confirmation of availability. In case of exceptionally high order volume, LOG-LAB Hügli may reject express orders or propose alternative delivery dates.
5.5Digital Delivery and Security
Digital scans are provided via a private, password-protected portal with an expiry date. The personal portal is intended exclusively for the customer and may not be shared with third parties.
The customer is responsible for downloading and securely archiving the data. After expiry of the storage period (30 days) the data will be irreversibly deleted.
6.Ownership and Copyright
6.1Ownership of Film Material
The film material submitted remains the property of the customer.
6.2Processing Rights for Order Fulfilment
However, LOG-LAB Hügli is granted the right to reproduce and process the material and to store it temporarily in digital form for the purpose of fulfilling the order.
6.3Third-Party Rights / Assurances
The customer assures that they hold all necessary rights to the submitted material and that the processing does not infringe copyrights, personality rights or trademark rights of third parties. LOG-LAB Hügli assumes no liability for infringements resulting from customer-submitted material.
6.4Copyright and Rights of Use
Copyright in the photographic content (motifs, composition) remains entirely with the customer. LOG-LAB Hügli provides a technical service (development, scanning, editing) and thereby does not acquire any rights in the image content.
The delivered digital scans and negatives may be used commercially by the customer without restriction, reproduced and resold. LOG-LAB Hügli does not claim any licence fees, royalties or participation in commercial exploitation.
6.5Editing Style
LOG-LAB Hügli applies its own presets and colour interpretation when digitising. The aesthetic rendering of the scans (colour, contrast, tonal values) is part of LOG-LAB Hügli's editing style and is delivered for free use.
7.Data Protection
7.1Principle / Legal Basis
LOG-LAB Hügli processes personal data exclusively in accordance with the applicable Swiss data protection law (DSG).
7.2Controller
The controller responsible for data processing is LOG-LAB Hügli (contact details as per the imprint in these GTC).
7.3Processed Data / Archiving
Collected data (name, address, contact details, invoicing data, order-related information) are processed to handle the order and are archived for 10 years where legally required (in particular for accounting and evidentiary obligations) or necessary to trace orders.
7.4Deletion of Digital Image Data
Digital image data and scans are deleted after expiry of the storage period (30 days).
7.5Disclosure to Third Parties
Personal data are only disclosed to third parties insofar as this is necessary for contract performance (e.g., shipping providers, IT/hosting providers for communication and provision of download links).
7.6Rights of the Data Subject
The customer has the right to information, correction and—where legally provided—deletion as well as the right to receive their data. Requests must be submitted in writing to info@log-lab.dev. Further information is set out in the privacy notice of LOG-LAB Hügli.
7.7Notice of Potentially Criminal Content
If, in the course of processing, LOG-LAB Hügli identifies content that, to the best of its judgement, indicates or constitutes criminal acts (including prohibited symbols, depictions of violence, sexual acts involving minors, or terrorist propaganda), LOG-LAB Hügli is entitled to temporarily suspend processing and stop the order internally. LOG-LAB Hügli reserves the right to secure and transmit the information, documents and files required to clarify the facts (including relevant negatives, relevant image files, order/Project ID and customer data) to the competent authorities to the extent necessary.
8.Liability
8.1Duty of Care
LOG-LAB Hügli treats all submitted film material with the greatest possible care.
8.2Limitation of Liability for Slight Negligence
In cases of slight negligence, liability is limited to the replacement value of the undeveloped film (material value), but to a maximum of CHF 50.– per film.
8.3Cardinal Obligations
In the event of a breach of essential contractual obligations (cardinal obligations), LOG-LAB Hügli shall be liable—where legally permissible—for the typical, foreseeable damage, also limited to CHF 80.– per film.
8.4Non-Material Value
Compensation for non-material value (e.g., sentimental value of images) is excluded to the extent legally permissible.
8.5Gross Negligence / Intent
In cases of gross negligence or intent, LOG-LAB Hügli shall be liable in accordance with statutory provisions.
8.6Customer Cooperation / Packaging Errors
LOG-LAB Hügli is not liable for damage resulting from improper packaging by the customer, illegible labelling, or incorrect information.
8.7Force Majeure
In case of force majeure (e.g., fire, water damage, technical failures), liability is excluded.
9.Complaints
9.1Deadline / Deemed Acceptance
Complaints regarding faulty development, incomplete delivery or other defects must be made in writing within 14 days of receipt of the delivery. After this period, the service shall be deemed accepted.
9.2Consequences
In the event of justified complaints, LOG-LAB Hügli may, at its discretion, offer rework, replacement or an appropriate refund.
9.3Complaints Procedure
Complaints must be submitted in writing by email to the stated contact address and must include:
- Order number
- Detailed description of the defect
- If possible: image material or screenshots for documentation
LOG-LAB Hügli reviews each complaint carefully and responds within 5 working days with a statement and proposed solution.
10.Right of Withdrawal
10.1Exclusion of Withdrawal / Returns
As film development is an individual, customer-specific service, there is no statutory right of withdrawal or return.
10.2Applicability to Postal/Online Orders
This also applies to orders placed by post or online.
11.Applicable Law and Jurisdiction
11.1Applicable Law
Swiss substantive law shall apply to all legal relationships between LOG-LAB Hügli and the customer. The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
11.2Place of Jurisdiction
To the extent legally permissible, the place of jurisdiction for disputes arising out of or in connection with these GTC and the contracts concluded under them is Bern (Switzerland). Mandatory statutory jurisdictions, in particular for consumers, remain reserved.
12.Severability
12.1Continued Validity
Should individual provisions of these GTC be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
12.2Replacement Provision
The invalid or unenforceable provision shall be replaced by the applicable statutory provision. If no statutory provision exists, a provision shall be deemed agreed that comes as close as possible to the economic purpose.
13.Order Acceptance and Labelling
13.1Labelling at Intake
Each film submitted is placed in an envelope at intake and labelled with essential information. This includes:
- Name and contact details of the customer
- Unique order number
- Selected service package
- Date of intake and expected completion date
- Desired delivery method (download link, post)
13.2Labelling in the Process
During the development process, films are labelled with twin stickers to ensure seamless traceability.
14.Changes to the GTC
14.1Right to Amend
LOG-LAB Hügli reserves the right to amend or supplement these GTC if there are objective reasons (e.g., changes in legal requirements, adjustments to services/processes, or security requirements).
14.2Publication / Validity
Changes will be published on the website and apply to all orders placed after publication. Existing orders are not affected; the GTC valid at the time the order was placed shall apply.
14.3Information in Case of Material Changes
Customers will be informed of material changes in an appropriate manner (e.g., by email).
